BUSINESS TORTS
Bondurant Mixson & Elmore, LLP has been highly successful in both prosecuting and defending lawsuits involving business torts. For example, the firm:
- Won a $454 million jury verdict – the largest verdict in Georgia history – for the plaintiffs in a breach of fiduciary duty action against Time Warner
- Obtained a defense verdict for Wyle Laboratories in a jury trial in which the plaintiff claimed damages in excess of $150 million. The National Law Journal recognized the firm’s defense of this case as one of the Top 10 defense verdicts of the year 2000
- Defeated class action RICO and fraud claims against AT&T, including obtaining a reversal from the United States Court of Appeals for the Eleventh Circuit of the trial court’s grant of class certification
- Won a defense jury verdict for Box USA on business tort claims in which the plaintiff sought $120 million in damages.
The firm owes its extraordinary success in litigating business torts to the quality of its attorneys, who have consistently been ranked among the top litigators in the state and country. Indeed, in 2004, nearly 40% of the firm’s partners were ranked among the top 100 attorneys in the state, as well as among the Best Lawyers in America.
The firm’s experience in representing both plaintiffs and defendants in business tort cases also contributes to its success. This varied experience allows us to craft novel and compelling arguments for the successful prosecution of such cases, or to anticipate and preempt similar strategies by opposing counsel when we represent the defendant.
Our business tort cases have included suits brought by competitors, partners, employees, minority shareholders and consumers, based upon special statutory provisions or basic common law theories, such as fraud and breach of fiduciary duty. Many of the cases we handle are brought or defended on a class action basis.
