CLASS ACTIONS

Bondurant Mixson & Elmore has successfully litigated class actions on both the plaintiffs’ and the defense side, resulting in the firm being recognized as having one of the premier class action practices in the United States. 

The firm’s successes in class action litigation include:

  • Obtaining a $192.5 million settlement – the largest settlement of a private class action race discrimination lawsuit in United States history - for approximately 2000 employees of The Coca-Cola Company.  Ingram v. The Coca-Cola Company, 200 F.R.D. 685 (N.D. Ga. 2001).
  • Defeating class claims in a major consumer action against our client, including obtaining a reversal from the United States Court of Appeals for the Eleventh Circuit of the trial court’s grant of class certification.  Andrews v. American Tel. & Tel. Co., 95 F.3d 1014 (11th Cir.1996).
  • Obtaining certification of a class of approximately 3000 foster children alleging that foster care and child protective services in Atlanta are legally and constitutionally deficient.  Kenny A. v. Perdue, Civil Action No. 1: 02-CV- 1686-MHS.
  • Obtaining the dismissal of a massive securities fraud class action suit brought against the former officers and directors of RDM Sports Group, Inc.

Due in part to the firm’s experience and success in litigating class actions, several of the firm’s attorneys have been invited to author articles or to lead seminars on class action litigation.  For example, Jay Elmore serves as the Chair of Georgia’s annual ICLE Class Action Seminar and is the Eleventh Circuit contributing editor to the American Bar Associations’ Class Actions and Derivative Suits Newsletter, Michael Terry has lectured on the availability of punitive damages in class actions and Steven Rosenwasser authored Employment Discrimination Class Actions: The Importance of Case Selection, an article that was published in the Bureau of National Affairs' Class Action Litigation Reporter.
