The firm has broad and deep experience representing both plaintiffs and defendants in the resolution of high-stakes professional liability disputes. Indeed, Bondurant Mixson & Elmore, LLP has enjoyed the professional compliment of having been asked to represent more than one hundred law firms or lawyers in professional liability disputes. The firm's experience extends to disputes in the fields of accounting, architecture and engineering, though our professional liability practice focuses on the professional duties and liabilities of attorneys, corporate directors and officers and public officials.
Our work for directors and officers has extended to multinational businesses and has seasoned us in the complexities of professional liability disputes arising from international commerce. We have sued and defended public officials in a variety of settings, from the defense of reverse race discrimination claims, to the prosecution of claims against correctional officials. Some illustrative highlights of our professional liability work include:
- Successful defense of directors and officers of a Canadian multinational financial institution in litigation with a U.S.regulator alleging losses in excess of $1 billion;
- Successful defense of a prominent Atlanta law firm against professional liability claims;
- Successful defense of directors and officers in a series of putative class actions alleging securities and RICO violations and seeking amounts in excess of $500 million;
- Mediated resolution of claims against a prominent Atlanta law firm in a series of consolidated cases brought by more than 150 tax shelter investors (represented defendant; settlement amount confidential);
- Successful prosecution of First Amendment claims against public education officials in a church/state controversy.
In addition to direct representation of professional liability plaintiffs and defendants, we have acted as national coordinating counsel for multi-jurisdictional matters concerning directors and officers, and have extensive experience counseling insured professionals and, on occasion, their insurers, in coverage and other related insurance matters. Our experience in handling both sides of professional liability cases gives our professional judgment the balance and perspective needed to evaluate cases accurately and to select the most effective path toward resolution. Although professional liability cases are often resolved short of trial or litigation, the firm's track record of achieving good results ultimately rests on our demonstrated abilities as trial and appellate advocates.
